TEPJF  que AMLO viol\u00f3 ley al pedir el voto para tener mayor\u00eda en Congreso"},"content":{"rendered":"\n<p>La Sala Superior del Tribunal Electoral del Poder Judicial de la Federaci\u00f3n (TEPJF) confirm\u00f3 que <strong>el presidente Andr\u00e9s Manuel L\u00f3pez Obrador viol\u00f3 la Constituci\u00f3n <\/strong>en su conferencia matutina del 19 de abril, cuando pidi\u00f3 votar por los candidatos de su \u201cmovimiento\u201d para tener <strong>mayor\u00eda en el Congreso de la Uni\u00f3n<\/strong>.<\/p>\n\n\n\n<p>En sesi\u00f3n p\u00fablica, la Sala Superior confirm\u00f3 la sentencia emitida por la Sala Especializada el pasado 26 de octubre, en la que se resolvi\u00f3 que <strong>el mandatario viol\u00f3 la normativa electoral <\/strong>cuando asegur\u00f3 que para concretar las \u00faltimas reformas de su gobierno ser\u00e1 necesario que se vote por candidatos a legisladores federales de su partido y tener una mayor\u00eda calificada en el Congreso de la Uni\u00f3n.<\/p>\n\n\n\n<p>La Sala Especializada concluy\u00f3 que con las expresiones hechas por L\u00f3pez Obrador en esa \u2018ma\u00f1anera\u2019, <strong>se vulneraron los principios de imparcialidad, neutralidad y equidad <\/strong>y que se incurri\u00f3 en el uso indebido de recursos p\u00fablicos derivado de la emisi\u00f3n y difusi\u00f3n de sus declaraciones.<\/p>\n\n\n\n<p>Adem\u00e1s de declarar responsable al mandatario, la sentencia <strong>orden\u00f3 sanciones <\/strong>al director del Centro de Producci\u00f3n de Programas Informativos y Especiales (Cepropie),<strong> Sigfrido de la Rosa<\/strong>, y al coordinador general de Comunicaci\u00f3n Social y Vocer\u00eda del Gobierno de la Rep\u00fablica, <strong>Jes\u00fas Ram\u00edrez<\/strong>, quienes impugnaron la resoluci\u00f3n de la Sala Especializada.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Al respecto, la Sala Superior confirm\u00f3 la sentencia al considerar que \u201ccontrariamente a lo afirmado por los recurrentes, la responsable s\u00ed es competente para conocer sobre los hechos denunciados porque tuvieron incidencia en procesos electorales locales en dos entidades federativas y podr\u00edan incidir en el proceso electoral federal\u201d.<\/p>\n<\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Adem\u00e1s, ratific\u00f3 que \u201clas manifestaciones denunciadas son llamados expresos al voto como lo concluy\u00f3 la responsable, ya que el Presidente transmiti\u00f3 a la ciudadan\u00eda su intenci\u00f3n de que las C\u00e1maras del Congreso de la Uni\u00f3n est\u00e9n integradas con personas afines a su movimiento, lo cual constituye una injerencia en la intenci\u00f3n de voto\u201d.<\/p>\n<\/blockquote>\n\n\n\n<p>Los inconformes tambi\u00e9n alegaron que la resoluci\u00f3n de la Sala Especializada <strong>los obligaba a desobedecer las \u00f3rdenes de su superior jer\u00e1rquico<\/strong>, que es el Presidente.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>No obstante, la Sala Superior expuso que dicha sentencia \u201cno constituye alguna habilitaci\u00f3n para romper con la jerarqu\u00eda u obediencia administrativa, ya que, es en esa determinaci\u00f3n, se precis\u00f3 que se incumpli\u00f3 con el deber de cuidado por no realizar acciones tendentes a evitar la vulneraci\u00f3n de los principios constitucionales, sin que ello redunde en un lineamiento o procedimiento fuera de los l\u00edmites impuestos por el ordenamiento jur\u00eddico a los funcionarios p\u00fablicos\u201d.<\/p>\n<\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\">Pide investigar expresiones durante informe<\/h2>\n\n\n\n<p>En otra sentencia, la Sala Superior orden\u00f3 a la Sala Especializada emitir una nueva resoluci\u00f3n para analizar de forma adecuada, exhaustiva y contextual diversas <strong>expresiones que hizo el Presidente de la Rep\u00fablica <\/strong>durante un discurso emitido en el evento denominado \u201cQuinto Aniversario del Triunfo Democr\u00e1tico del Pueblo de M\u00e9xico\u201d, el 1 de julio pasado.<\/p>\n\n\n\n<p>La Sala Superior consider\u00f3 que hay <strong>posibles referencias a partidos pol\u00edticos de oposici\u00f3n <\/strong>que pueden generar un impacto indebido en el proceso electoral federal.<\/p>\n\n\n\n<p>Aunque confirm\u00f3 la inexistencia de la violaci\u00f3n a las reglas sobre informes de labores, como alegaba la senadora panista <strong>Kenia L\u00f3pez<\/strong>, por considerar que se trat\u00f3 de \u201cun ejercicio aut\u00f3nomo de rendici\u00f3n de cuentas\u201d, la Sala Superior revoc\u00f3 la parte en la que se <strong>omiti\u00f3 analizar las declaraciones del mandatario<\/strong>.<\/p>\n\n\n\n<p>Por ello, se orden\u00f3 a la Sala Especializada que emita una nueva resoluci\u00f3n en la que valore a profundidad dichas expresiones y determine lo que en derecho
