{"id":11170,"date":"2024-03-01T06:23:35","date_gmt":"2024-03-01T06:23:35","guid":{"rendered":"https:\/\/expresorgv.online\/home\/?p=11170"},"modified":"2024-03-01T06:23:36","modified_gmt":"2024-03-01T06:23:36","slug":"obtiene-cesar-duarte-amparo-contra-extradicion","status":"publish","type":"post","link":"https:\/\/expresorgv.online\/home\/blog\/2024\/03\/01\/obtiene-cesar-duarte-amparo-contra-extradicion\/","title":{"rendered":"Obtiene C\u00e9sar Duarte amparo contra extradici\u00f3n"},"content":{"rendered":"\n<p>El exgobernador C\u00e9sar Duarte <strong>obtuvo un amparo que invalida el proceso de extradici\u00f3n <\/strong>y el segundo juicio en su contra.<\/p>\n\n\n\n<p>La <strong>orden de aprehensi\u00f3n<\/strong>, dictada por la Jueza Amparo P\u00e9rez Barraza en el <strong>expediente 1260\/2017<\/strong>, fue anulada, junto con todas las actuaciones relacionadas con el proceso de extradici\u00f3n, <strong>por considerarse una violaci\u00f3n al Derecho de Audiencia de Duarte.<\/strong><\/p>\n\n\n\n<p>El Juez de Garant\u00edas determin\u00f3 que las acciones llevadas a cabo por la autoridad, <strong>desde la detenci\u00f3n hasta el juicio, fueron unilaterales<\/strong> y contrarias a los derechos del exgobernador.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/i0.wp.com\/editorial.aristeguinoticias.com\/wp-content\/uploads\/2023\/04\/cesar-duarte-jaquez-exgobernador-chihuahua-cuartoscur-09042023-700x438.jpg?resize=640%2C400&#038;ssl=1\" alt=\"\" data-recalc-dims=\"1\" \/><\/figure>\n\n\n\n<p id=\"caption-attachment-1278880\">Foto: Archivo. Cuartoscuro<\/p>\n\n\n\n<p>Este fallo tiene implicaciones directas en la segunda causa penal que enfrenta Duarte, y de la que su defensa argumenta que, seg\u00fan el tratado de extradici\u00f3n, el detenido solo deber\u00eda ser juzgado por <strong>una causa penal que origin\u00f3 la captura en otro pa\u00eds.<\/strong><\/p>\n\n\n\n<p>La defensa de Duarte reclam\u00f3 como inconstitucional la aplicaci\u00f3n del principio de excepcionalidad, que en agosto de 2023 anunci\u00f3 la gobernadora Mar\u00eda Eugenia Campos, <strong>ser\u00eda impuesto al caso del ex gobernador dada la solicitud de 2022, que orill\u00f3 a abrir un segundo proceso<\/strong> penal por el presunto delito de peculado por 120 millones de pesos.<\/p>\n\n\n\n<p>Ahora queda pendiente resolver el proceso consignado en el expediente <strong>3041\/2019<\/strong>, <strong>que constituye el primer juicio, por el presunto delito de peculado <\/strong>que gener\u00f3 su captura en Estados Unidos en 2020.<\/p>\n\n\n\n<p>Con esta nueva resoluci\u00f3n del tribunal federal, <strong>a favor de C\u00e9sar Duarte, se impide abrir nuevos procesos penales<\/strong> y podr\u00eda cambiar su situaci\u00f3n jur\u00eddica.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>El exgobernador C\u00e9sar Duarte obtuvo un amparo que invalida el proceso de extradici\u00f3n y el segundo juicio en su contra.
